Terms and legal bases<\/span><\/h2>\n<h3 id=\"begriffe\"><span style=\"color: #695c15;\">2.1 Terms<\/span><\/h3>\n<p><span style=\"color: #695c15;\"><strong>Personal data<\/strong> is <em>any<\/em> information relating to an identified or identifiable natural person. A <strong>data subject<\/strong> is a person about whom we process personal data.<\/span><\/p>\n<p><span style=\"color: #695c15;\"><strong>Processing<\/strong> includes <em>any<\/em> handling of personal data, <em>regardless<\/em> of the means and procedures used, such as querying, comparing, adapting, archiving, storing, reading, disclosing, obtaining, collecting, recording, deleting, disclosing, arranging, organizing, storing, modifying, disseminating, linking, destroying and using personal data.<\/span><\/p>\n<p><span style=\"color: #695c15;\">The <strong>European Economic Area (EEA)<\/strong> comprises the <a style=\"color: #695c15;\" href=\"https:\/\/de.wikipedia.org\/wiki\/Mitgliedstaaten_der_Europ%C3%A4ischen_Union\" target=\"_blank\" rel=\"nofollow noopener\">member states of the European Union<\/a> (EU) as well as the Principality of Liechtenstein, Iceland and Norway. The General Data Protection Regulation (GDPR) refers to the processing of personal data as the processing of personal data.<\/span><\/p>\n<h3 id=\"rechtsgrundlagen\"><span style=\"color: #695c15;\">2.2 Legal basis<\/span><\/h3>\n<p><span style=\"color: #695c15;\">We process personal data in accordance with Swiss data protection law, in particular the <a id=\"95769\" style=\"color: #695c15;\" href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/491\/de\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Federal Act on Data Protection<\/a> (Data Protection Act, DPA) and the <a style=\"color: #695c15;\" href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/568\/de\" target=\"_blank\" rel=\"nofollow noopener\">Ordinance on Ordinance<\/a> (Data Protection Ordinance, DPO).<\/span><\/p>\n<p><span id=\"rechtsgrundlagen-dsgvo\" style=\"color: #695c15;\">We process &#8211; if and insofar as the General Data Protection Regulation (GDPR) is applicable &#8211; personal data in accordance with <em>at least<\/em> one of the following legal bases:<\/span><\/p>\n<ul>\n<li><span style=\"color: #695c15;\"><a style=\"color: #695c15;\" href=\"https:\/\/steigerlegal.ch\/dsgvo\/dsgvo-6\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Art. 6 para. 1 lit. b GDPR<\/a> for the necessary processing of personal data for the performance of a contract with the data subject and for the implementation of pre-contractual measures.<\/span><\/li>\n<li><span style=\"color: #695c15;\">Art. 6 para. 1 lit. f GDPR for the necessary processing of personal data in order to protect the legitimate interests of us or of third parties, except where such interests are overridden by the fundamental freedoms and rights and interests of the data subject. Legitimate interests are, in particular, our interest in being able to carry out our activities and operations in a permanent, user-friendly, secure and reliable manner and to communicate about them, to ensure information security, to protect against misuse, to enforce our own legal claims and to comply with Swiss law.<\/span><\/li>\n<li><span style=\"color: #695c15;\">Art. 6 para. 1 lit. c GDPR for the processing of personal data necessary for compliance with a legal obligation to which we are subject under any applicable law of Member States of the European Economic Area (EEA).<\/span><\/li>\n<li><span style=\"color: #695c15;\">Art. 6 para. 1 lit. e GDPR for the necessary processing of personal data for the performance of a task carried out in the public interest.<\/span><\/li>\n<li><span style=\"color: #695c15;\">Art. 6 para. 1 lit. a GDPR for the processing of personal data with the consent of the data subject.<\/span><\/li>\n<li><span style=\"color: #695c15;\">Art. 6 para. 1 lit. d GDPR for the necessary processing of personal data in order to protect the vital interests of the data subject or another natural person.<\/span><\/li>\n<\/ul>\n<h2 id=\"art-umfang-zweck\"><span style=\"color: #695c15;\">3. Nature, scope and purpose<\/span><\/h2>\n<p><span style=\"color: #695c15;\">We process the personal data <em>required<\/em> to carry out our activities and operations in a permanent, user-friendly, secure and reliable manner. Such personal data may fall into the categories of inventory and contact data, browser and device data, content data, meta or marginal data and usage data, location data, sales data as well as contract and payment data.<\/span><\/p>\n<p><span style=\"color: #695c15;\">We process personal data for the <em>duration<\/em> required for the respective purpose(s) or by law. Personal data whose processing is no longer required will be anonymized or deleted.<\/span><\/p>\n<p><span style=\"color: #695c15;\">We may have personal data processed <em>by third parties<\/em>. We may process personal data jointly with third parties or transfer it to third parties. Such third parties are, in particular, specialized providers whose services we use. We also guarantee data protection for such third parties.<\/span><\/p>\n<p><span style=\"color: #695c15;\">We process personal data only with the consent of the data subject, unless the processing is permitted for other legal reasons. Processing without consent may be permissible, for example, to fulfill a contract with the data subject and for corresponding pre-contractual measures to protect our overriding legitimate interests, because the processing is evident from the circumstances or after prior information.<\/span><\/p>\n<p><span style=\"color: #695c15;\">In this context, we process in particular information that a data subject <em>voluntarily<\/em> provides to us when contacting us &#8211; for example by post, email, instant messaging, contact form, social media or telephone &#8211; or when registering for a user account. Personal data abroad<\/span><\/h2>\n<p><span style=\"color: #695c15;\">We <em>generally<\/em> process personal data in Switzerland and the European Economic Area (EEA). However, we may also export or transfer personal data to other countries, in particular in order to process it or have it processed there.<\/span><\/p>\n<p><span style=\"color: #695c15;\">We may export personal data to all <a style=\"color: #695c15;\" href=\"https:\/\/de.wikipedia.org\/wiki\/Liste_der_Staaten_der_Erde#Tabelle\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">countries and territories<\/a>, provided that the law there guarantees adequate data protection in accordance with the <a style=\"color: #695c15;\" href=\"https:\/\/steigerlegal.ch\/2022\/09\/10\/ndsg-schweiz-staatenliste\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">decision of the Swiss Federal Council<\/a> and &#8211; if and insofar as the General Data Protection Regulation (GDPR) is applicable &#8211; in accordance with the <a style=\"color: #695c15;\" href=\"https:\/\/commission.europa.eu\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions_de\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">decision of the European Commission<\/a>.<\/span><\/p>\n<p><span style=\"color: #695c15;\">We may transfer personal data to countries whose laws do not guarantee adequate data protection, provided that data protection is guaranteed for other reasons, in particular on the basis of standard data protection clauses or with other suitable guarantees. Exceptionally, we may export personal data to countries without adequate or appropriate data protection if the special requirements under data protection law are met, for example the express consent of the data subjects or a direct connection with the conclusion or execution of a contract. We will be happy to provide data subjects with information on any guarantees upon request or provide a copy of any guarantees.<\/span><\/p>\n<h2 id=\"rechte\"><span style=\"color: #695c15;\">5. Rights of data subjects<\/span><\/h2>\n<h3 id=\"ansprueche\"><span style=\"color: #695c15;\">5.1 Data protection claims<\/span><\/h3>\n<p><span style=\"color: #695c15;\">We grant data subjects all rights in accordance with the applicable data protection law. The persons concerned are obliged to cooperate.<\/span><\/p>\n<h3 id=\"beschwerderecht\"><span style=\"color: #695c15;\">5.2 Right to lodge a complaint<\/span><\/h3>\n<p><span style=\"color: #695c15;\">Data subjects have the right to enforce their data protection claims through legal action or to lodge a complaint with a competent data protection supervisory authority.<\/span><\/p>\n<p><span style=\"color: #695c15;\">The data protection supervisory authority for private controllers and federal bodies in Switzerland is the <a style=\"color: #695c15;\" href=\"https:\/\/www.edoeb.admin.ch\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Federal Data Protection and Information Commissioner (FDPIC<\/a> ).<\/span><\/p>\n<p><span style=\"color: #695c15;\">Data subjects have &#8211; if and insofar as the General Data Protection Regulation (GDPR) is applicable &#8211; the right to lodge a complaint with a competent <a style=\"color: #695c15;\" href=\"https:\/\/edpb.europa.eu\/about-edpb\/about-edpb\/members_de\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">European data protection supervisory authority<\/a>.<\/span><\/p>\n<h2 id=\"sicherheit\"><span style=\"color: #695c15;\">6. Data security<\/span><\/h2>\n<p><span style=\"color: #695c15;\">We take appropriate technical and organizational measures to ensure data security appropriate to the respective risk. However, we cannot guarantee absolute data security.<\/span><\/p>\n<p><span style=\"color: #695c15;\">Our website is accessed using transport encryption (SSL \/ TLS, in particular with the Hypertext Transfer Protocol Secure, abbreviated to HTTPS).
